Terms of service
TERMS OF SERVICE
Welcome to Marked by Fate. These Terms of Service apply when you visit our website or purchase products from us.
Throughout these terms, “we”, “us” and “our” refer to Marked by Fate, and “you” and “your” refer to the customer or website visitor.
By placing an order with us, you agree to these Terms of Service. Please read them carefully before making a purchase.
1. About us
Marked by Fate is an online retailer based in the United Kingdom.
Trading name: Marked by Fate
Email: Markedbyfate.uk@gmail.com
2. Our products
We aim to describe and photograph our products as accurately as possible.
Please be aware that colours may appear slightly different depending on your screen or device.
Many of our products are handmade, assembled or personalised, meaning there may occasionally be small variations between products. These variations are not necessarily considered faults.
Product availability is subject to change without notice.
3. Blind Date with a Book and book boxes
Where a product is sold as a Blind Date with a Book, the identity of the book is intentionally not disclosed before purchase.
We will provide information such as the genre, themes, tropes or other characteristics where applicable.
Receiving a book title that you would not personally have selected does not, by itself, mean the product is faulty or not as described, provided the product otherwise matches the description given when you ordered.
This does not affect your statutory consumer rights or any applicable right to cancel an online purchase.
4. Personalised and custom products
It is your responsibility to check any names, wording, spellings, colours or other personalisation details you submit.
Please check all personalisation carefully before placing your order.
Once production of a personalised or custom-made item has started, changes may not be possible.
Products made to a customer’s specifications or clearly personalised are generally excluded from the standard statutory change-of-mind cancellation right. This does not affect your rights where an item is faulty, damaged, incorrect or not as described.
5. Orders
When you place an order, you will receive an order confirmation using the contact details provided at checkout.
Receiving an order confirmation does not necessarily mean that we have accepted an order where, for example, there has been an obvious pricing error, suspected fraud, a product is unavailable or we are otherwise unable to fulfil the order.
If we cannot fulfil your order, we will contact you and refund any amount you have paid for the affected item.
6. Prices and payment
All prices are displayed in GBP (£) unless stated otherwise.
Any applicable taxes and delivery charges will be displayed before you complete your purchase.
Payment must be made using one of the payment methods available at checkout.
We reserve the right to change our prices at any time, but a price change will not affect an order that has already been accepted.
7. Discount codes and promotions
Discount codes must be entered at checkout and cannot normally be applied retrospectively.
Discounts may have their own eligibility requirements and expiry dates and may not be used together unless specifically stated.
We reserve the right to cancel or amend a promotion where necessary, without affecting orders already validly placed under that promotion.
8. Delivery
Delivery times and charges are explained in our Shipping Policy.
Any delivery estimates provided are estimates unless we expressly agree to a specific delivery date with you.
Under UK consumer law, goods generally remain at the trader’s risk until they come into the physical possession of the customer or another person the customer has identified to receive them, subject to limited exceptions where the customer arranges their own carrier.
9. Returns, cancellations and refunds
Our returns and refunds are governed by our separate Returns & Refund Policy, which forms part of these terms.
For eligible online purchases, consumers generally have 14 days after receiving the goods to notify the trader that they wish to cancel, subject to legal exceptions including certain personalised products.
Nothing in these terms limits your statutory consumer rights.
10. Faulty, damaged or incorrect products
If your product arrives faulty, damaged, incorrect or not as described, please contact us at Markedbyfate.uk@gmail.com as soon as reasonably possible.
We may ask for photographs or other information so that we can understand the issue.
We will provide an appropriate remedy in accordance with your statutory rights.
11. Intellectual property
Unless otherwise stated, the content of the Marked by Fate website, including our branding, original photographs, graphics, written content and original designs, belongs to us or is used by us with permission.
You may not reproduce, distribute, sell or commercially exploit our original website content or designs without permission.
Nothing in this section claims ownership over third-party book covers, titles, characters, quotations, trademarks or other intellectual property belonging to their respective rights holders.
12. Website use
You must not knowingly misuse our website, attempt to gain unauthorised access to it, introduce malicious software or use the website for unlawful or fraudulent purposes.
We may restrict access to our website where reasonably necessary to protect our business, customers or website.
13. Third-party services
Our website may use services provided by third parties, including Shopify and payment, delivery and social-media providers.
Third-party websites and services may have their own terms and privacy policies.
We are not responsible for content on third-party websites that we do not control.
14. Our liability
Nothing in these terms excludes or restricts liability where doing so would be unlawful, including your statutory consumer rights.
We will not be responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses arising from a purchase made wholly or mainly for personal use, except where the law provides otherwise.
15. Events outside our reasonable control
We will not be responsible for delays caused by circumstances genuinely outside our reasonable control.
Where such circumstances materially affect your order, we will take reasonable steps to keep you informed and fulfil our obligations as soon as reasonably possible.
Your statutory rights regarding delayed delivery remain unaffected.
16. Changes to these terms
We may update these Terms of Service from time to time.
The terms applying to your purchase will normally be those available when you placed your order.
17. Governing law
These terms are governed by the laws applicable in England and Wales.
If you are a consumer living elsewhere in the UK, this does not deprive you of any mandatory consumer protections that apply to you.
